The drug and alcohol program are a federal law created by the department of transportation (DOT) and was designed to prevent accidents and injuries caused by impaired driving in the USA higways and roads



Who does it apply?


If you are an employer who hires CDL drivers, and they drive a CMV of more 26.000 pounds you are required to have a DOT random drug and alcohol program for your drivers. No matter if you are local o drive out state, or if you are owner operator or hires more driver. YOU NEED TO HAVE IT!!!


What is a Drug and alcohol consortium o CTP/A?


A drug and alcohol consortium is a company that manages or administrate the drug and alcohol program for the trucking companies and is also call CTP/A consortium or third party administrator.


The consortium must meet a minimum DOT requirement to be able to administrate your random drug and alcohol program:


A DOT random drug and alcohol program should have the following components:

  • A testing frequency that meets or exceeds the minimum annual percentage rate established by the DOT for each type of test (drug or alcohol). DOT Required that CTPA meets 50% of random selection during the year for drug testing and 10% for alcohol testing. That means that at least 50% of the driver in your drug and alcohol program pool needs to be tested for drugs during the year and 10% for alcohol. And that percentage must divided in 4 selections one for each quarter.

  • A random selection process that ensures that every driver has an equal chance of being tested each year. That means that each driver in the consortium pool have the same chance to be selected in each quarter no matter if you got selected in a previus quarter.

  • A testing procedure that follows the DOT guidelines for specimen collection, chain of custody, laboratory analysis, and medical review.

Labs must be qualified by DOT as well the MRO.

  2. If you are a owner operator the consortium must designated employer representative (DER) who is responsible for administering the program and communicating with the testing service. Y if you hire drivers you must designated employer representative (DER) that could be yourself.

  3. A recordkeeping system that maintains the documentation of the program and the test results.

  4. A referral, evaluation, and treatment program that provides assistance to drivers who test positive or refuse to test, and monitors their return-to-duty process.
