What’s at Stake?

If you or your drivers are in a “prohibited” status in the FMCSA’s Drug and Alcohol Clearinghouse, you’re at risk. The new rule means that anyone with a “prohibited” status will lose their CDL or CLP. Starting November 18, 2024, State Driver Licensing Agencies (SDLAs) will be required to downgrade licenses for drivers who have violations. That means no CDL or CLP, no commercial driving.

  2. Complete the RTD Process: To change your status from “prohibited” to “not prohibited,” you must complete the Return-to-Duty (RTD) process. This involves specific steps outlined in 49 CFR part 40, subpart O. This is your only route to getting back behind the wheel.
